General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through the My Dear Poppet online store on the Shopify platform.
Deviating terms and conditions of the customer will not be accepted unless My Dear Poppet expressly agrees to their validity in writing.

2. Subject matter of the contract

The online shop only offers digital products (knitting instructions in PDF format) for download.
These are not physical goods.

3. Conclusion of contract

1. The presentation of the products in the online shop constitutes a binding offer.

2. By clicking the “Buy now” button you place a binding order.

2. The contract is concluded when My Dear Poppet confirms the order.

4. Prices and payment terms

1. All prices are in euros and include – where applicable – statutory value-added tax.

2. Payment is made using the payment methods offered during the ordering process (e.g. credit card, PayPal, direct bank transfer).

5. Delivery of digital content

1. The ordered instructions will be provided exclusively in digital form (download link or email delivery).

2. The goods will be made available immediately after receipt of payment, at the latest within 24 hours.

3. The customer is responsible for having suitable software and devices to open and use the files.

6. Right of withdrawal

1. According to Section 356 (5) of the German Civil Code (BGB), the right of withdrawal expires as soon as the execution of the contract has begun, i.e. as soon as the download has started or the file has been delivered.

2. The customer expressly agrees that the right of withdrawal expires upon commencement of the contract.

7. Rights of use

1. All knitting instructions are protected by copyright.

2. With the purchase, the customer receives a simple, non-transferable right of use for private use .

3. Any distribution, reproduction, publication or commercial use of the instructions (e.g. sale, exchange, transfer to third parties or commercial production based on the instructions) is expressly prohibited.

8. Warranty

The statutory warranty rights apply.
Since these are digital products, My Dear Poppet assumes no liability for incompatibilities with specific software or devices of the customer, provided the files have been properly provided.

9. Liability

My Dear Poppet is only liable for damages caused intentionally or by gross negligence. Any further liability is excluded.

10. Final provisions

1. The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

2. Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.

3. The place of jurisdiction is – to the extent permitted by law – the registered office of My Dear Poppet.
