General Terms and Conditions (GTC)

1. Scope of application

These General Terms and Conditions (GTC) apply to all orders placed via the My Dear Poppet online shop on the Shopify platform.
Any deviating terms and conditions of the customer shall not be recognised unless My Dear Poppet expressly agrees to their validity in writing.

2. Subject matter of the contract

Only digital products (knitting patterns in PDF format) are offered for download via the online shop.
These are not physical goods.

3. Conclusion of contract

1. The presentation of the products in the online shop constitutes a binding offer.

2. By clicking on the ‘Buy now’ button, you are placing a binding order.

2. The contract is concluded upon confirmation of the order by My Dear Poppet.

4. Prices and terms of payment

1. All prices are in euros and include statutory value added tax, where applicable.

2. Payment is made using the payment methods offered during the ordering process (e.g. credit card, PayPal, instant bank transfer).

5. Delivery of digital content

1. The ordered instructions are provided exclusively in digital form (download link or email delivery).

2. Provision will generally take place immediately after receipt of payment, at the latest within 24 hours.

3. The customer is responsible for having suitable software and end devices to open and use the files.

6. Right of withdrawal

1. For digital content, § 356 (5) BGB applies: The right of withdrawal expires as soon as the execution of the contract has begun, i.e. as soon as the download has started or the file has been delivered.

2. The customer expressly agrees that the right of withdrawal expires upon commencement of the contract.

7. Rights of use

1. All knitting patterns are protected by copyright.

2. Upon purchase, the customer receives a simple, non-transferable right of use for private use.

3. The transfer, reproduction, publication or commercial use of the patterns (e.g. sale, exchange, transfer to third parties or commercial production according to the patterns) is expressly prohibited.

8. Warranty

The statutory warranty rights apply.
As these are digital products, My Dear Poppet accepts no liability for incompatibilities with the customer's specific software or devices, provided that the files have been supplied correctly.

9. Liability

My Dear Poppet is only liable for damages caused by intent or gross negligence. Any further liability is excluded.

10. Final provisions

1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

2. Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.

3. The place of jurisdiction is – to the extent permitted by law – the registered office of My Dear Poppet.
